What is the difference between a fee and a surcharge?

A fee is a charge that is pre-programmed into the payment system or POS and disclosed upfront as part of the transaction. When configured correctly and transparently, this can be compliant.

A surcharge occurs when a business adds or adjusts a charge on the back end specifically to recover credit card processing costs. Even if disclosed, this is no longer considered a fee — it is classified as a surcharge and can become illegal if done incorrectly.

What does Texas law say about credit card surcharges?

Texas law (Business & Commerce Code Chapter 604A) restricts how credit card surcharges may be applied. Improperly adding or passing along credit card processing costs to customers — especially outside of a compliant, disclosed pricing structure — can result in violations, even if the intent is transparency.

What is the difference between a pre-programmed device fee and manually adding a fee on the back end?

A pre-programmed device fee is applied automatically at the point of sale as part of a compliant pricing structure. Manual back-end adjustments are not automated, are often inconsistent, and can be classified as surcharges.

Additionally, manual adjustments can make it appear that a business collected more revenue than it actually earned, which may impact reporting and taxes — even though the added amount was only intended to offset processing costs, not increase profit.
